The agreement governing your use of Desi Junction Films website and services.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you" or "your") and Desi Junction Films ("Company," "we," "us," or "our") governing your use of desijunctionfilms.website and the digital marketing and production services we provide. By using our website or engaging our services, you confirm you have read, understood and agree to be bound by these Terms.
By using our website or engaging our services, you represent that you are at least 18 years old, have legal authority to enter into binding agreements, and agree to these Terms in full. If using our services on behalf of an organisation, you further represent you have authority to bind that organisation to these Terms.
Desi Junction Films provides digital marketing services including Google Ads management, Facebook and Meta advertising, search engine optimisation (SEO), social media marketing, email and WhatsApp marketing automation, video and creative production, brand strategy and related consulting. Specific services, deliverables, timelines and fees are detailed in the Service Agreement or Statement of Work (SOW) executed for each engagement.
Our fees are as outlined in your Service Agreement. Management fees do not include ad spend, which is paid directly by the client to advertising platforms. All fees are quoted in Indian Rupees (INR) unless otherwise stated.
We reserve the right to adjust pricing with 30 days' written notice. Continued engagement after notice constitutes acceptance of new pricing.
Upon full payment, we assign to the Client ownership of all custom creative assets produced specifically for the Client under the engagement. This excludes our proprietary methodologies, frameworks, templates and tools, which remain the sole property of Desi Junction Films. The Client retains all rights to their pre-existing brand assets and materials.
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement, including business strategies, financial information, campaign performance data and trade secrets. This obligation survives termination for 3 years.
Desi Junction Films will use commercially reasonable efforts to achieve agreed marketing goals. However, due to the variable nature of digital marketing platforms and algorithms, we make no guarantees regarding specific results, rankings or return on investment. Platform policy changes, market conditions and algorithm updates are outside our control.
To the maximum extent permitted by applicable law, our total liability shall not exceed the total fees paid by you in the three months preceding the claim. We shall not be liable for indirect, incidental, consequential or punitive damages including lost profits, loss of data or business interruption.
These Terms are governed by the laws of India. Disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Mumbai, Maharashtra under the Arbitration and Conciliation Act 1996. Language: English.
